Leicester’s Hospitals Challenge Harborough District Council At High Court

Legal proceedings against Harborough District Council by Leicester’s Hospitals are being heard in the High Court.
The Judicial Review was secured by the NHS Trust after its request for £1m from developers, set to build over 2,700 homes near Lutterworth, was rejected.
The hospitals argue such a large housing scheme will place a huge burden on existing health services and the money is needed towards the additional cost of providing services to residents of the development.
The Trust is challenging the council’s decision not to include it in a ‘Section 106’ agreement for the approved Lutterworth East scheme, which details where developers must fund improvements to infrastructure and services impacted by new homes.

Legal teams are representing the Council and Leicester Hospitals NHS Trust at the two-day hearing.
Leicestershire County Council, which is the developer for the scheme, is also represented as an ‘interested party’.
