Hospital Trust Gets Permission For Judicial Review Over Lutterworth East Scheme

Leicester’s Hospitals have been granted permission to take legal proceedings against Harborough District Council.
A High Court judge has ruled a Judicial Review can be heard, after the The University Hospitals of Leicester NHS Trust was awarded no money to cope with the influx of patients it says a massive new housing development near Lutterworth will bring.
Hospital bosses are challenging the council’s decision not to include it in a ‘Section 106’ agreement for the 2,700-home Lutterworth East scheme – which details where developers must fund improvements to infrastructure and services impacted by new homes.
It had requested just under £1m towards hospital services for future occupants, saying such a large housing scheme will place a huge burden on existing health services, including Leicester Royal Infirmary.
The area set for the development
Leicestershire County Council was granted planning permission for the major development, adjacent to the M1, in 2020.
Richard Mitchell, chief executive at Leicester’s Hospitals, said: “We have sought a judicial review to support our aim in making sure the people of Leicester, Leicestershire and Rutland have timely and safe access to health care services.”
The Judicial Review will be heard during a two-day hearing at the High Court in London next month.
Harborough District Council told HFM it would not be appropriate for the council to comment ahead of the hearing.
